District Court of Nebraska – Dan Ketcham & Alberto Hernandez

A defense verdict was obtained in a personal injury action premised on theories of strict product liability and negligence. It was alleged that the delivered ready-mixed concrete was defective because sufficient warnings were not provided to do-it-yourself consumers. Plaintiffs further argued that the ready-mixed supplier was negligent for failing to provide a warning that wet ready-mix concrete was dangerous and could cause chemical burns. After deliberation, the jury found that Plaintiffs failed to prove both claims against the ready-mix supplier and issued a unanimous defense verdict.
