Dan Ketcham – Douglas County District Court, NE Dan Ketcham successfully defended Kiewit Building Group in a personal injury claim brought by Robert Thomas, an iron worker who was injured during the construction of the TD Ameritrade Building. Thomas argued that the general contractor’s obligation to provide a safe workplace extended to the condition of the floors which were slick during winter construction. Kiewit argued that it met the standard of care and acted reasonably. Plaintiff had a spinal fusion and was 100% disabled. Plaintiff asked for $3.8 million dollars. The jury returned a defense verdict.
