Summary judgment in favor of a veterinarian and clinic where plaintiff alleged professional negligence in connection with the care of her canine and insurance fraud. The Court ruled that Plaintiff did not successfully rebut prima facie evidence of following the standard of care. An unsworn statement from a veterinarian was not received into evidence for lack of foundation and otherwise did not sufficiently provide the necessary testimony of a breach of the standard of care. The insurance fraud cause of action was dismissed for lack of standing as Plaintiff was not a party to the insurance contract between the clinic and insurer.
