Robert Keith and Alexis Wright recently secured a complete summary judgment win for Economy Premier Assurance Company in a coverage case filed in the U.S. District Court for the District of Nebraska that involved competing motions for summary judgment. In this breach of contract case, the dispositive issue was whether or not the plaintiff, a homeowner, was entitled to indemnification under a replacement coverage provision for a supplemental claim that was made more than a year after the time limit set forth in the policy. In sustaining their client’s Motion for Summary Judgment and denying the plaintiff’s Motion for Partial Summary Judgment, the trial court found that there was no merit to plaintiff’s statute of limitations argument or the other issues he raised, and it held that the policy provision was unambiguous, and the plaintiff failed to submit a timely supplemental claim.
