District Court for Dodge County, Nebraska – Kristina Kamler
This multi-case litigation involved ten nuisance and trespass cases filed against a concrete mixing facility that had commenced its operations in 1964. On behalf of the facility we argued that the facility had a prescriptive easement to continue their operations, even if those activities are a nuisance to and/or result in a trespass upon adjacent residential properties. The Court agreed and dismissed the nuisance cases.
